Insurance & protection

Every car must carry statutory third-party motor insurance and a valid NTSA inspection certificate. New bookings have no platform fee or protection-plan charge. Free platform use does not include additional insurance cover. Confirm with the host that the vehicle's policy permits rental use and check its cover, exclusions and excess before your trip.

1. Who we are

Drivein Kenya Ltd operates a marketplace connecting vehicle owners (hosts) with renters. Drivein is not a car rental company and does not own the vehicles listed. The rental contract is between the host and the renter; Drivein facilitates discovery, verification, payment and support.

2. Eligibility

Renters must be at least 23 years old with two years' driving experience and a valid Kenyan driving licence, or a foreign licence accompanied by an International Driving Permit. Hosts must present a logbook in their name (or written owner consent), a valid NTSA inspection certificate and a current motor insurance certificate.

3. Payments and commission

Drivein is free to use for hosts and renters. New bookings have no service fee, protection charge or host commission. Renters still pay the host's vehicle rental price, selected extras and delivery. Hosts keep the full rental subtotal without a Drivein commission deduction. Host payouts are disbursed to a registered M-Pesa number every two weeks for completed trips. Prices displayed include VAT where applicable. Existing bookings retain their original prices.

4. Cancellations and refunds

Each listing displays its own cancellation window, typically 24 to 72 hours before pickup for a full refund. Cancellations inside the window attract a 50% charge. If a host cancels a confirmed booking, the renter receives a full refund plus a KSh 1,000 rebooking credit. Refunds return to the original M-Pesa number or card within three working days.

5. Mileage, fuel and tolls

Daily mileage limits are shown on each listing; extra kilometres are charged at the host's published rate. Fuel is returned per the stated policy. Tolls, parking and traffic fines incurred during the rental period are the renter's responsibility.

6. Damage claims

Damage must be reported in-app within 24 hours with photographs, and a police abstract is required for accidents, theft or third-party involvement. Drivein reviews both sides' evidence within five working days. Cover, exclusions and any excess depend on the vehicle's actual insurance policy; free platform use does not provide insurance cover.

7. Off-platform bookings

Trips arranged or paid for outside Drivein are not eligible for Drivein booking and dispute support. Accounts that repeatedly move bookings off-platform may be suspended or removed.

8. Conduct and suspension

Drivein may suspend or remove any account for fraud, document falsification, harassment, dangerous driving, unauthorised subletting, or repeated late cancellations. Verified complaints are reviewed by our trust and safety team.

9. Data and privacy

We collect identity documents, licence details and phone numbers solely for verification, payments and safety, and we process them under the Kenya Data Protection Act, 2019. Documents are stored encrypted and are never shared with other users.

10. Governing law

These terms are governed by the laws of Kenya. Disputes not resolved through Drivein's internal process may be referred to mediation in Nairobi before any court action.
